The case of the complainant Sri. Jayachandran.K is that he had purchased a NOKIA X2-01 model mobile phone from opposite party No.1 on 1-6-2011 for `3950/-. But on the 6th day itself the screen display is not functioning properly and was entrusted to opposite partyNo.1 for repair. Opposite party No.1 did not repair it but returned the mobile phone without repairing the same. Hence the complaint for necessary redressal.
2. Opposite parties remained absent inspite of receipt of notice sent by registered post. Opposite parties had to be set exparte.
3. Complainant is examined as PW1. Ext.A1 and A1 (a) are the Users Manual and the stamp of the opposite party. The complainant purchased the NOKIA X2-01 on 1-6-2011 and the same became defective on 6-6-2011. The complainant entrusted the mobile to opposite party No1 for repair, opposite party No.1 informed the complainant that this type of defects can only be repaired by service engineers and assured him to inform the date of coming of service engineers. Again he approach opposite party No.1 but on that occasion he was sent back. Due to the irresponsible act of opposite party No.1, complainant suffered mental agony and monetary loss. It is the duty of opposite party No1, to give after sale service to their customers. Mobile phones are highly necessary for the day to day life and people and they are not ready to wait for a long time for repair. Here the complainant purchased the mobile phone on 1-6-2011 but it went wrong within a short period i.e. 6 days. But opposite party No.1 was not ready to heed the complaint of the customer. The complainant was compelled to give a complaint before the Forum for the remedy.
In the result, the complaint is allowed and opposite party No.1 is directed either to exchange the defective set with a new set or refund `3950/- with a compensation of `1000/-and cost of `1500/- within 30 days from the date of receipt of this order.
