The complainant has filed the complaint against the OP causing deficiency of service described as follows:-
The complainant purchased a HONDA CB Shine motor cycle bearing Registration No. OD22C8054, chasis No.ME4JC36NBF7273041 and Engine No. JC36E73957704 from the OP on 20.03.2015. The complainant paid Rs 61,000/- only in cash for the cost of the vehicle along with insurance, road tax & other accessories to the OP. In the next day the complainant found that the back tyre was damaged and old one. It was a coloring & resoling tyre. The complainant informed this matter before the OP. The later assured to the former that within no time the said damaged tyre would be exchanged. According to the assurance of the OP the complainant used to go to the work shop again & again but the OP tantalized the complainant & did not exchange the old & damaged tyre. On 23.08.2015 the OP refused to supply a new tyre to the complainant. He has filed some documents in connection with his pleadings. He has prayed for exchanging a new tyre in place of the old & damaged one & claimed cost & compensation.
On the other hand the OP has denied the averments claimed made by the complainant in the para No. 1, 2 & 3 of the complaint. He has also admitted a part of the averments made in the para No. 4 & denied other part & described some contradictory facts in the para No. 5 & 6 of in the written version.
FINDINGS
The complainant made a compromise with the OP out of this Forum. There was a mutual discussion held by both the parties that the OP paid Rs 2,000/- to the complainant for the cost of the new tyre. The complainant was agreed, and received Rs 2,000/- (Rupees two thousand only) from the OP for his claim with full satisfaction. Hence he has filed a petition to drop this CD Case. He also admitted he did not want proceed with the case. Hence ordered;
ORDER
The complaint is & the same be dropped here with without cost.
