ORDER

By R. VIJAYAKUMAR, MEMBER Complainant has filed this complaint for getting Rs.50,000/- as compensation, Rs.15,000/- as the Excess expenses incurred by the complainant andRs.1000/- as cost. In the averments in the complaint can be briefly summarized as follows: The complainant had booked two buses from the Travel Agency under the proprietorship of the opp.party, for the marriage of the complainant which was conducted on 29.4.2007 at DevamrithaM Kalyana Mandapam, Kochulloor, Thiruvananthapuram complainant paid Rs.250/- as advance amount. There was an agreement that the buses will arrive northern side of Udaya Junction, Mynagappally at 6 p.m. But that agreement we violated by the opp.party. Because of the circumstances created by the opp.party, the complaint forced to make other arrangements and he had incurred an excess expense of Rs.15000/-. Due to the act of opp.party, complainant suffered mental agony and hardships. Hence the complainant filed this complaint for getting relief. The complainant filed affidavit. Opp.party remained absent. Hence he stands exparte. The points which are to be determined are: 1. Whether there is deficiency in service on the part of opp.party. 2. Whether the complainant deserves for the compensation, excess expenditure and cost. The complainant could prove his case through the complaint land affidavit. There is deficiency in service on the part of opp.party. In the result the complaint is allowed, directing the opp.party to pay back advance amount of Rs.250/- along with 9% interest per annum and Rs.5000/- as compensation and excess expenditure and Rs.1000/- as cost to the complainant. The order is to be complied with within one month from the date of receipt of this order. Dated this the 2nd day of April, 2008.
