            The case of the complainant is that on 10.9.2008 complainant purchased a churidar cloth, worth Rs.1000/- from the opposite party’s shop.  Thereafter complainant entrusted the material to a nearby tailor shop for stitching.  From there, the tailor informed the complainant that the Churidar material has no sufficient cloth and it is not fit to make a dress and also informed the complainant that around 50 cm. cloth is short to make a churidar for a normal sized lady.  Due to the insufficient measurement of the cloth, complainant was not able to stitch the same.  Therefore complainant is seeking relief against the opposite party to return an amount of Rs.1000/- towards the cost of the material and a compensation of Rs.5000/-.

 

            Complainant filed affidavit and he was examined as PW1.  Exts. A1 to A3 were marked on the side of the complainant.  MO1 was also produced and marked.  After juridical notice, MO1 returned to the complainant.

 

            After serving notice, opposite party called absent and set exparte.

 

            From the affidavit, Exts. A1 to A3 and also from MO1, complainant’s case is proved.

 

            In the result petition is allowed and the opposite party is directed to return an amount of Rs.1000/- being the value of the churidar material and a compensation of Rs.1500/- to the complainant.

 

            Pronounced in open Court this the 27th day of February 2009.
