1.Alleging deficiency of service and unfair trade practice, the complainant filed this case against the O.Ps for compensation of Rs.5,000/-.
2.The brief fact of the case is that on 22.7.2017, the complainant has purchased 2 pairs of foot wear from the O.Ps and on payment of Rs.190/- for the cost of two pairs. If the O.P provide cash memo an extra Rs.30/- to be paid by the complainant. So the complainant paid Rs.220/- for the cost of two pairs of foot wear. The O.P by adopting unfair trade practice did not supply the bill and supplied an estimate slip of Rs.220/- for the cost of 2 foot wear instead of supplying original cash memo. So the complainant filed this case before this forum for compensation of Rs.5,000/-.
3. Being noticed, the O.Ps appeared in this case and did not file any counter nor take part in the hearing for which he was set ex-parte.
4.The complainant is a consumer under C.P.Act and he has paid Rs.220/- for the cost of 2 pairs of foot wear. The O.P. supplied estimate slip of Rs.220/- to the complainant instead of supplying original cash memo by adopting unfair trade practice. As such the O.P caused unfair trade practice against the complainant.
Taking into consideration of the case of the complainant and documents filed by him, we allow the case of the complainant in part and direct the O.P to supply original cash memo alongwith Rs.4,000/-(Rupees four thousand) only towards compensation for his mental agony within one month from the date of this order, failing which the complainant is at liberty to take steps against the O.Ps for realization of awarded amount. This case is disposed of accordingly.
