The complaint has been filed by the complainant U/S 12 of Consumer Protection Act 1986 alleging deficiency in service on the part of the opposite party in selling an used Industrial Sewing Machine as brand new machine to the complainant seeking direction to pay a sum of Rs.55,000/- being the repair charges and to pay a sum of Rs.10,00,000/- mental agony suffered by the complainant due to the negligent service of the opposite party and to pay a sum of Rs.2,52,000/- towards cost of this complaint.
No representation for both. Proof affidavit of complainant not filed inspite of sufficient opportunities. Hence, we are of the view that no fruitful purpose would be solved by keeping the complaint on file. Complaint dismissed for non-prosecution. No cost.
