Final Order / Judgement

Complainant is present. Opposite Party is also present alonwith his authorized representative.  Both parties submitted that they have settled their disputes outside Court as per the joint compromise petition dated 14.12.2018 being executed between the complainant and O.P. being identified by the Ld. Counsel of the Opposite Party, wherein it is agreed by both the parties that the O.P. will transfer the ownership of the alleged vehicle in dispute in favour of the Complainant in the office of RTO, Malkangiri. Complainant will refund the outstanding dues amounting Rs. 11,800/- towards balance installment of two months to the O.P.  O.P. will pay an amount of Rs. 5,000/- to the complainant towards compensation and costs of litigation charges and Opposite Party will change the insurance of alleged vehicle in favour of the complainant and no further claim will be there against each other from either side.

Perused the compromise petition dated 14.12.2018 filed by both the parties.  It is ascertained from the compromise petition dated 14.12.2018 that both the parties have settled their disputes amicably outside Court and complainant does not want to proceed the case further.  It is also ascertained in regard to the existence of the terms and conditions as mentioned in the compromise petition, both the parties have given their consent to that effect and complainant settled the dispute to his entire satisfaction.  Therefore, on the basis of the compromise petition dated 14.12.2018, we are inclined to drop the case hence forth.

Keeping in view of the above compliance made between the parties, we have no hesitation to close the case.  Hence the present case is closed henceforth.
