Final Order / Judgement

Complainant is present. O.P. No. 2 is represented through authorized representative.  Complainant and A/R for O.P. No. 2 submitted that they have settled their disputes outside Court as per the joint compromise petition dated 04.12.2018 being executed between the complainant and O.P. No. 2, wherein it is agreed by both the parties that the O.P. No. 2, on behalf of both the Opposite Parties, will pay an amount of Rs. 24,000/- towards the costs of the alleged product in shape of cheque or amount to be transferred in the account of complainant and Rs. 5,000/- towards compensation and costs of litigation to the complainant and in return, the complainant will handover the alleged product to the O.P. No. 2 and the complainant will have no further claim against the Opposite Parties in regard to the alleged product in future.

                                    Perused the compromise petition dated 04.12.2018 filed by both the parties to the present disputes and receipt memos both dated 19.12.2018 filed by them.  It is ascertained from the compromise petition dated 04.12.2018 and the receipt memos filed by both the parties that they have settled their disputes amicably outside Court and complainant does not want to proceed the case further.  Further it is ascertained that the complainant received an amount of Rs. 29,000/- towards full and final satisfaction of the compromised petition vide cheque no. 029356 dated 11.12.2018 for Rs. 29,000/- drawn on Oriental Bank of Commerce issued in the name of the complainant, by the O.P. No. 2 and the O.P. No. 2 has received the alleged disputed product from the complainant to their satisfaction and also it is found that no party have any claim against each other in future.  Therefore, on the basis of such compromise petition dated 04.12.2018 and receipt memos dated 19.12.2018, we are inclined to drop the case hence forth.

Keeping in view of the above compliance made between the parties, we have no hesitation to close the case.  Hence the present case is closed henceforth.
