The case is the Complainant is that he had purchased a LG FLATRON LED from the Opposite party No-2 through the Opposite Party No-1 by paying a sum of Rs. 15,850/- (Fifteen thousand eight hundred fifty only) for which an invoice no. T-00534 dated 05.02.2024 has been brought on record. According to the Complainant soon after its purchase and thereafter its use the LED shows several defects for which the complainant could not get its utility. Immediately the complainant report the matter to the Opposite Parties but on several persuasion the OP No-3 sent his Engineer who failed in his attempt to repair the same.
Upon notice, the OP No-1 filed his version through registered post. In his version the OP No-1 submitted that being a dealer he in no way is liable and in the event of any compensation the manufacturer is liable.
Despite notice, the OP No-2 & 3 neither appeared nor filed their version hence, they set Ex-parte.
In the absence of any representation from the Opposite Party no-3 and having gone through the documents and all other evidence placed before us by the Complainant. We are of the considered opinion that the LED supplied by the Opposite Party No-3 is a defective piece as it gave trouble right from the 1st day of its purchase/use and being the manufacturer of the said product the OP No-3 is liable for deficiency in service.
Hence we are inclined to pass the following :-
ORDER
We direct the Opposite Party No-3 is directed refund and amount of Rs. 15,850/- (Fifteen thousand eight hundred fifty only) to the Complainant and pay Rs. 5,000/- as compensation for harassment and to pay Rs. 2,000/- towards the cost of litigation to the Complainant within 30 days the receipt of this order. Failing which, the Opposite Party No-3 shall be liable to pay Rs. 100/- for each day of delay till the payment is made.
