Parties are absent on call. However in view of sec 38(3)(c) of C.P Act 2019 ,record taken up for final disposal on merit.

Perused the material available on record . we have our thought full consideration to the respective contention of the parties. This complaint is presented against the O.Ps alleging defects in the purchased goods i.e. Refrigerator model Voltas VISI Cooler VC FT320 of Rs.32,000/- and pray for an order directing O.Ps to provide a new one replacing the said defective refrigerator.

On being notice the OPs present and submitted that, they have already replaced the defective Refrigerator with new one of same model to the satisfaction of the complainant without charging extra cost to the complainant and pray for dismissal of this complaint.

Though the complaint admitted the fact that the defective refrigerator has already been replaced with new one by the O.Ps, he is calming compensation for the harassment cause due to defects arose in the alleged goods.

Nothing cogent available on record to prove the deficiency of service on the part of O.ps, rather it is found that the O.Ps have promptly replaced the defective Refrigerator with new one of same model without charging any extra cost to the complainant ,which is duly acknowledged by the complainant himself as such we do not found elements to proceed any more in this complaint we are of our consider view that there is no deficiency in service on the part of O.Ps towards the complaint. Hence complaint against the O.Ps is dismissed, however no order as to cost.
