Deficiency in service in respect of non-supply of monthly energy bill in spite of lot of persuasion are the allegations arrayed against the Opp.Parties.

Complaint in nutshell reveals that complainant is a consumer under Ops bearing Consumer No.KMPO-31 and computerized A/C No.02180251 and was availing power supply under Kutir Jyoti Scheme provided by Govt. of Odisha. It is alleged that the Ops are not supplying the monthly energy bills regularly even on repeated requests. But the staffs of Ops on ending month of each financial year coming and collecting arrear dues. It is also stated that complainant is ready to pay the energy dues regularly, but in absence of any monthly energy bills payments are not possible to pay regularly. On dtd.11.01.2013 when Ops threatened to disconnect the power supply complainant’s premises, complainant paid Rs.2,000/- vide MR No.115687. Hence, the complaint before the Forum with prayer that a direction may be given to Ops for regular service of monthly energy bills with a direction to not to disconnect the power supply.
3. Being noticed Ops appeared through their Ld. Counsel and filed joint written statement submitting the facts that complainant is a domestic category of consumer under Ops bearing Consumer No.02180251 and is availing power supply without installation of meter as a result no monthly energy bill was possible to serve. It is averred in the written statement that to settle the dispute complainant has to install a meter to redress the grievance. In the circumstances, the Ops have not committed any deficiency in service and due to latches of the complainant and cover up the same a false case has been foisted which deserves to be dismissed.
4. Heard, the arguments advanced by Ld. Counsels for the parties. The admitted facts of the case are that complainant is a consumer under Ops bearing Consumer No.02180251 and the complainant has no meter from the date of power supply accordingly average bills are/were prepared. The reason of non-installation of meter is not properly explained by the parties. During course of submission Ld. Counsel for complainant filed a photo copy of meter testing certificate bearing meter No.2721505. This Forum is not sure whether the said meter is installed or not ? Ops in their written statement averred that the dispute of non-service of energy bills as alleged by the complainant will be resolved if a meter is installed and revision of energy bills will be done as per the rules. In the circumstances, we direct the complainant to install an approved meter as per the provisions of the Ops, if not installed earlier. The Ops will revise monthly energy bills for non-meter period as per their rules and regulations and will withdraw the bills prepared on basis of average consumption. The installation of meter by complainant will be completed within one month of receipt of the order. After installation of meter the Ops will revise the energy bill within 120 days of installation of meter, defaulting parties will pay Rs.50/- per day as delayed charge.
Accordingly, the complaint is allowed in part without cost.
