Extract of Order No.16 dtd.19.12.2016

                         Complainant and Ld. Counsel for Ops filed hazira. Heard the submission of Ld. Counsel for Ops and case of the complainant on merit as complainant remain absent on repeated calls. In the complaint, it is alleged that complainant is a domestic category of consumer under Ops bearing consumer No.-D17M13 and consumer A/C No.-02137553. It is alleged that the Ops ignoring  the request of the complainant imposed illegal, arbitrary energy bills and prayed this Forum for revision  of energy bills along with compensation and cost of litigation. Ops resisted the claim and submitted that complainant as a consumer having aforesaid consumer number. The meter bearing No. No-00007-33748 found defunct, same was replaced by meter No.RLY7985355 at the cost of the complainant. The complainant’s said meter was also replaced by the Ops on the month  of July-2016 bearing meter No.VT-03160940.   The  allegation   and  counter allegations are supported by photocopies of monthly energy bills filed by complainant, copies of billing statement produced by the Ops. Considering the submissions and on presentation of documents it clear that complainant is a domestic category of consumer under Ops bearing No.-D17M13 which correspondence to consumer  A/C No.-02137553 and  from the billing statement it appears that the meter was defective and bills were prepared an average basis from 6/2010 to 7/2010 and 12/2015 to 7/2016 and  Ops are ready to revise the energy bill and as the Ops installed their own digital meter complainant has to pay the meter charges as per the law on monthly wise basis in this aspect complaint is silent regarding changing of meters as submitted by the Ops.

                        Having observations reflected above it is directed that Ops will revise the monthly energy bills of the complainant from Dec-2015 to July-2016 as per the provisions of O.E.R.C. and will issue fresh revised energy bill to the complainant. The order passed on the I.A. case No.6/16 is hereby  vacated and if any amount is deposited in pursuance to the order of I.A.Case, same to be adjusted on the monthly energy bill  of the complainant. The revision of energy bill and  service of the revised bill will be served on the complainant within one month of receipt of this order, failing with Rs. 50/- will be charged for the delayed period.  

                                     Complaint is allowed in part on merit.
