Extract of Order No.14 dtd.09.01.2017

 

                                            In the complaint it is alleged that complainant is  coming under BPL category having Sl.No.16/17 vide card No.25922 of Badhia Gram Panchayat under Mahakalpada Block. As per the guidelines of Govt. of Odisha free electricity connection is given to the BPL families and complainant is selected to get the BPL electricity connection. But the Ops on several request do not provide the new service connection under BPL and prayed this Forum for direction to Ops  for new service connection to complainant. On the other hand Ops appeared into the dispute states that the BPL card is not in the name of the complainant and the same is issued in the father of the complainant namely Bandhu Behera who is dead. It is further stated that no material is available and no KIT under the scheme is given to supply power under BPL. Hence, the complaint be dismissed.

                                       Considering  the submission, it is clear that complainant has not paid a single ‘pie’ to the Ops as consideration to avail the power supply. Complainant’s sole allegation is he deserves to get new service connection on free as per the guidelines of Govt. of Odisha. In the present complaint when no ‘consideration’ has been paid to the OP and without payment of any ‘consideration’ providing of service does not arise at all. According to C.P.Act,1986 the complainant can not be treated as a consumer under section-2(d)(ii) of C.P.Act,1986. Further the scheme launched by the Govt. as stated by the complainant is  a free service provided to the peoples under BPL. Such matters or allegations can not be adjudicated by this Forum.

                         Accordingly, complaint is dismissed without any cost.
