F I N A L O R D E R
1.Dilip Debnath here-in-after called the complainant has filed this complaint against the O.Ps alleging inter alia that the complainant being a businessman deposited Rs.3,30,500/- in 3 installments for purchasing a vehicle of model No. LPT 1512 from the O.Ps. Sri Bhajan Debnath, Authorized Signatory of Progressive Automobiles Pvt. Ltd., the O.P. No.1 issued a receipt. But ultimately the O.Ps showing this and that reason did not deliver the vehicle to the complainant although the complainant had deposited the sum of Rs.3,30,500/-. Lastly on 06.11.2021 the complainant sent request letter but to no good. On 10.08.2021 Legal Notice was served but no result. Hence this complaint for a direction to the O.Ps to return the sum of Rs.3,30,500/- along with compensation.
2.The O.Ps particularly the O.P. No.1 and 3 in their written objection denied the allegations of the complainant and pleaded that the complainant is not a consumer as he purchased the vehicle for commercial purpose and further pleaded that one Rana Das booked the vehicle from O.P. No.1 and 3 on Down Payment of Rs.3,30,500/- out of the total amount of Rs.20,88,800/-. Ultimately Rana Das due to some reason could not purchase the vehicle and entered into an agreement with the present complainant that the complainant shall pay the installment to the O.Ps but the complainant after payment of 2 nos. of installment stopped payment of installment. As such the finance company confiscated the vehicle. Hence, the complainant has suppressed the real fact.
3.The complainant submitted the evidence on affidavit with documents.
3.1The O.Ps also submitted evidence with documents.
4.Hearing argument following points are taken up for discussion and decision:-
(i) Whether the complainant ever entered into any Higher Purchase Agreement with the O.Ps for purchasing vehicle of Model No- TATA LPT 1212 and entered into an agreement with Rana Das who originally booked such vehicle from the O.Ps?
Whether the complaint of the complainant is barred on the ground of commercial purpose?
6.The case stands disposed off.
7.Supply copy of this Order to both the parties free of cost.
