              1.  This complaint is filed under section 35 of Consumer Protection Act 2019 and stood over to this date for consideration and this Commission passed the following order.

 

              2.  This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint notice was issued to the opposite parties. On receipt of notice the first opposite party filed version. The third opposite party was struck of on the basis of the memo filed by the complainant dated 23.07.2021.Since then the case was posted for taking steps against second opposite party. As the complainant was continuously absent and not taken steps against second opposite party, this Commission issued a notice to complainant to appear before this Commission today to further proceed with this complaint. The notice issued to the complainant was served. Complainant not appeared. Not taken any steps against second opposite party. Complainant called absent. In the above circumstances, we find that the complainant is not interested to further proceed with this complaint.

                     In the result, the complaint is dismissed for default. There shall be no order as to costs.

                     A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
