This case record has been placed before the ld. Judges of Grahak Madhyasthotah Samadhan Lok Adalat which is held on this day at the court room of D.C.D.R.C., Hooghly. Ld. Advocate and J/dr side are found ready. D/hr side is not taking any steps in this case since 2.9.2022. As per submission of the recorded Lawyer of D/hr he has no connection with the d/hr. Ld. Lawyer for the J/dr side pointed out that Hon’ble State Commission has been pleased to dispose of the appeal No.A/43/2020 as the disputes involved in this case have been amicably settled. It is also pointed out by the Ld. Advocate for the J/dr side that the J/dr has already executed deed of assignment in favour of the D/hr. As per submission of the Ld. Advocate of the J/dr side as the disputes involved in this case have been amicably settled, the D/hr side is not interested to take any steps.
From the case record, it appears that one Confonet downloaded copy of the order of Hon’ble State Commission passed in appeal no.A/43/2020 dated.6.3.2023 has been filed by the J/dr side wherefrom it is revealed that there is amicable settlement in between the parties. More so, the J/dr side is filing two affidavits and one deed of assignment which also going to depict that parties have settled their disputes involved in this case and the J/dr side has executed the deed of assignment.
As the disputes involved in this case have been amicably settled, Ld. Judges of this Lok Adalat are of the view that there is no further necessity of dragging this case.
In the result it is accordingly,
ORDERED
That this Execution case be and the same is dropped as the disputes involved in the case have been amicably settled.
Let the affidavits and deed of assignment filed by J/dr side be made a part of this order. Let the warrant of arrest issued against J/drs Abhishek Bagaria and Anurag Bagaria and against Krishna Chandra Saha be recalled. Let it be informed to the concerned Police Station.
The J/dr side is directed to deposit Rs.10,000/- in the Consumer Legal Aid account within two months from this date of order by Bank Draft of Nationalized Bank.
Let a free certified copy of this order be handed over to the parties immediately.
