Today is fixed for ex parte hearing. The complainant files a petition praying for withdrawal of the case on the ground that he is not willing to proceed with the case.

The complaiannat is personally present.  Heard the Complainant. As the Complainant is not willing to proceed with this case, the case is required to be dismissed for non-prosecution.

                 Hence, it is

that the instant case No. CC/65/2021 be and the same is here by dismissed for non-prosecution but under the circumstances without costs.
