OP exparte. PER MADHU MUTNEJA, MEMBER This case has been filed by Smt.Rajeshwari Tripathi against the OP for non supply of gas-cylinder well in time. 1] The complainant is a consumer of OP vide Consumer No.633733. She had booked a gas-cylinder with the OP on 28.4.2010. The complainant waited in vain for the cylinder and despite many requests for delivery of the gas-cylinder, the OP did not send the gas-cylinder to the complainant. The complainant has submitted that she has only one gas-cylinder and when that cylinder finishes, she is left harassed till the new filled gas-cylinder arrives. She has thus filed this complaint against the OP. 2] After admission of the complaint, notice was sent to OP. OP was duly served but none appeared on its behalf on the next date of hearing i.e. 14.6.2010, hence it was proceeded exparte. 3] At the time of arguments, the complainant submitted that the gas-cylinder had been delivered to her in June, 2010. However, she wished to emphasis on the fact that she had only one gas-connection and the OP was indulging in unfair trade practice by not giving her a cylinder on time when booked as promised by them. The OPs were already exparte, hence there was no one to say anything on their behalf. 4] It is clear case of a harassed consumer, who has suffered because of late delivery of gas-cylinder. She definitely needs to be compensated by the OP for the harassment suffered by her due to their deficient act and unfair trade practice. 5] In view of the above, we allow this complaint with a direction to the OP to issue a second gas-cylinder to her on payment as per norms, so that she does not suffer the same problem again. The OP is also directed to pay to the complainant Rs.2000/- towards compensation for deficiency in service. The aforesaid new cylinder will be issued to the complainant and the decreed amount shall be paid by the OPs within 30 days from the date of receipt of certified copy of this order, failing which they shall give to the complainant the cylinder as well as the amount of Rs.2000/- with interest @12% per annum, from the date of this order till its actual payment. Certified copies of the order be supplied to the parties free of any charge. The file be consigned to the record room after compliance.
