Adv.A.D'Souza files an application stating that the parties have mutually settled the complaint out of this Forum and submits that as a part of settlement the Complainants have signed a declaration of settlement informing that the complaint has been resolved amicably as part of the settlement a sum of Rs. 90,000/- paid towards membership is refunded. As per the said declaration of settlement the Complainant has also submitted that they are withdrawing the complaint filed by them before the Courts as against the OP. From the Roznama it is also observed that the Complainant has refused and neglected to remain present before this Forum on last four hearings i.e. on 15/11/2013, on 16/01/2014,on 14/02/2014 and on 05/03/2014. Adv.A.D'Souza for OP submits that the Complainants are not interested in pursuing with the complaint as they have been reimbursed with their amount which they had paid.We therefore have no other alternative but to dismiss the complaint of the Complainant for non prosecution.
