O R D E R

1. Complainant are husband and wife. They deposited a total amount of Rs.2,27,000/- by way of fixed deposit and season deposit with the opposite parties. Agreed rate of interest was 7.5% and 10.50% for fixed deposit and season deposit respectively for a period of one year. The total amount to be repaid after the due date was Rs. 2,50,291/- After the due date when the complainant approached the Opposite parties for the said amount, Opposite party evaded the Complainant stating flimsy reason. Thereafter on February 2008, the then Secretary committed suicide. On 10^th March 2008, an application was preferred to the newly selected Secretary and President of the Opposite party society. Complainant has not yet received any amount. According to the complainant, act of Opposite parties amount to deficiency of service. Complainant is claiming the deposited amount together with interest and Rs.10,000/- as compensation for the delay caused.

    

2. Opposite parties were set ex-parte.

    

3. Complainant filed proof affidavit. Exhibit A1 to A6 marked.

    

4. Accordingly to the complainants they are entitled for a total amount of Rs.2,50,291. From Exhibit A1 to Exhibit A6, it is evident that the complainants are entitled for the said amount. Opposite parties has not adduced any contra evidence.

5. In the result, complaint allowed. Opposite parties are directed to pay an amount of Rs.2,50,291/- and Rs.20,000/- as compensation and Rs.1000/- as cost of proceedings within one month from the date of communication of order failing which the whole amount shall carry an interest at the rate of 9% per annum from the date of order till realization.
