ORDER

Today the matter is fixed for cross-examination of the complainant witnesses.

Three witnesses, namely, Sri Arjun Roy, Sri Biplab Das and Sri Pradip Kr. Das have appeared on behalf of the complainants.

Heard Mr. S. Bhattacharjee, Ld. Counsel appearing for the complainants as well as Mr. R. Saha, Ld. Counsel appears on behalf of the opposite party-Insurance Company. Heard also Mr. L. Datta, Ld. Counsel appears for the opposite party-Bank.

Before cross-examination of the witnesses produced by the complainants, all the Ld. Counsel appearing for the parties have submitted that the complaint petition to be disposed of with direction to the opposite party nos.1, 2 and 3 to resurvey the claims of the complainants in their complaint petition. Accordingly, we heard them and the complaint petition is disposed of with the following directions:-

1. The complainant shall submit the copy of the complaint petition along with the documents submitted before this Court to the Insurance Company, i.e. the opposite party nos.1, 2 and 3 and the opposite party nos.1, 2 and 3 will examine those documents and will do the resurvey on the basis of those documents and the Bank records so far the claim of the complainants are concerned within one month from the date of submission of the complaint petition, if necessary the opposite party nos.1, 2 and 3 may collect the necessary stock statements and other necessary documents from the Bank, if so advised.
2. The opposite party nos.1, 2 and 3 shall communicate the result of the resurvey to the complainants just after one month. If the complainants are not satisfied with resurvey report then they are at liberty to approach the appropriate Forum, if so advised.

                Office is directed to handover all the documents submitted by the complainants to them and also to keep photocopy of the same with the record file.

                With the above directions, the instant complaint case is disposed of.

                Copy of this order be furnished to the Ld. Counsel appearing for the parties.
