Gheevarghese, President: Complaint filed under section 12 of the Consumer Protection Act. The Opposite Parties are declared exparty. The gist of the Complaint is as follows. The Complainant is a Consumer in Marathat Sudha Jala Padhathy, 58 families are the members in the scheme. According to the terms and conditions of the scheme a member family will be supplied up to 6000/- litre of water per month. The each member has to give Rs.50/- as the subscription fees towards the consumption of water. The Complainant filed petition in Taluk Legal Service Authority Sulthan Bathery No.176/06. The petition was settled agreeing that the (Contd ....... 2) - 2 - Opposite Parties will be supplied water uninterruptedly. The Opposite Party was not supplied watter even after the settlement arrived in Taluk Legal Service Authority Sulthan Bathery. Ext.A1 is the direction given by the Opposite Parties to the members in the scheme. Ext. A2 is the notice given to the Opposite Parties by Taluk Legal Service Authority. Ext. A3 is the true copy of the receipt given to the Complainant towards the payment of the monthly subscription. The Opposite Parties did not supply water to the Complainant intentionally. The allegation of the Complainant is that the Opposite Party was not supplied water four days even after the settlement agreed in Taluk Legal Service Authority Sulthan Bathery. The Complainant is entitled for the Compensation of Rs.3,500/- towards deficiency of service. The Complainant is a consumer of water supply scheme. The inferences shows that the water supply to the Complainant is interrupted. In the result the Opposite Parties are directed to give the Complainant Rs.1,000/- (Rupees One thousand only) towards the compensation and Rs.500/- (Rupees Five hundred only) towards cost. The Opposite Parties also directed to give this amount within one month from the date of this order. In case of any failure on the party of the Opposite Parties, the Complainant is entitled to execute this order as per the provisions of law.
