ORDER

 

 

JUSTICE J. M. MALIK, PRESIDING MEMBER (ORAL)

 

1.      The scheme floated by Registrar Cooperative Housing Society, Haryana includes one of the provisions i.e. clause 7.

Clause 7 reads as under:-

           

“If any loanee who have already deposited the amount of principal loan along with interest equal to loan amount, then his account should be treated Nil and his documents should be released.”

 

2.      Shri Prem Chand, the complainant took a loan of Rs.75,000/- from Narnaul Co-operative Housing Building Society Ltd. in the year 1995.  He was required to return the amount in 20 years by way of monthly instalments.  His contention is that he has already paid a sum of Rs.1,68,313/-  more than the double amount of the loan.  However, the petitioner, Haryana State Co-operative Housing Federation Ltd., opposite party, submits that only a sum of Rs.1,32,621.28/- stands paid.  Both the fora below have considered the   receipts    which  clearly  go to  show that the complainant had already paid a sum of Rs.1,68,313.28 vide receipts to the opposite party.  Learned counsel for the petitioner vehemently argued that all the receipts clearly go to show that the amount was paid to Narnaul Co-operative Housing Building Society.  The amount was not paid to the petitioner.  The petitioner can take action against the Narnaul Co-operative Housing Building Society Ltd. but they should not disturb Sh. Prem Chand, the complainant.

          No ground for interference is made out.

          The revision petition is accordingly dismissed.
