Heard. Learned counsel for respondent states that there is no objection if the impugned order passed by the State Commission is set aside and matter is remanded back to the State Commission for deciding the matter afresh in accordance with provisions of law, subject to heavy cost. In view of statement given by learned counsel for the respondent, the present revision petition is allowed, subject to payment of Rs.20,000/- (Rupees Twenty Thousand only) as cost. Cost be paid to respondent by the petitioner by way of demand draft within four weeks. In case, petitioner fails to pay the cost to the respondent within four weeks, the revision petition shall stand dismissed automatically without any further orders. Accordingly, we remand the matter back to the State Commission to decide the matter afresh in accordance with provisions of law after hearing both the parties. The State Commission shall make an endeavor to decide the appeal preferably, within one year from the date of receipt of copy of this order. Parties are directed to appear before the State Commission on 16.12.2013. Dasti to both the parties.
