O R D E R

 

NAWAB SINGH J, (ORAL)

 

1.      By filing the present appeal, National Insurance Company Limited -opposite parties (Insurance Company) has challenged the order dated April 28th, 2015 passed by District Consumer Disputes Redressal Forum, Faridabad (for short, ‘District Forum’) whereby complaint filed by Pardeep Kumar-complainant was allowed.  Insurance Company was directed to pay Rs.2,64,500/- (loss assessed by the surveyor) alongwith interest at the rate of 9% per annum from the date of filing of the complaint till realization within thirty days from the date of receipt of the order; Rs.5500/- as compensation and Rs.2200/- litigation expenses to the complainant.

2.      During pendency of the appeal, Insurance Company has given in writing (Annexure A-11) that they are ready to settle the matter with the complainant.

3.      In view of this, Insurance Company is directed to satisfy the award passed by the District Forum within one month from today and the complainant shall execute the letter of subrogation, hand over the keys of the vehicle and transfer the Registration Certificate in the name of the Insurance Company and execute all other necessary documents required for the purpose.

4.      Disposed off accordingly.

5.      The statutory amount of Rs.25,000/- deposited at the time of filing the appeal be refunded to the complainant against proper receipt and identification in accordance with rules, after the expiry of period of appeal/revision, if any.
