Order dated 06.01.2009 The complaint not present. Opposite party present. Complainant fails to file affidavit evidence. No body represented the complainant. The opposite party present in person and submitted that he is ready to give Sim Card to the complainant since the complainant has purchased mobile set from the opposite party. The opposite party submitted that the complainant has to give one photo, I.D proof and address proof. In view of the submission of the opposite party the request of the complainant that the opposite party has to provide free Sim Card has been accepted by the opposite party and same has to be allowed. Even though the complainant is not present and nobody represented him, in view of the admission of the opposite party the opposite party can be directed to give free Sim Card to the complainant as per the assurance. The complainant shall give photo, I.D proof and address proof since these things are required for issuing Sim Card. The opposite party is not entitled to take any charge or amount for activation of Sim Card. If at all, the opposite party is demanding the amount for activating the Sim Card it is illegal and such demand cannot be made. In the result, I proceed to pass the following:- ORDER The complaint is allowed. The opposite party is directed to give free sim card to the complainant without collecting any amount for activation. The complainant has to give one photo, I.D proof and Address proof. Order accordingly, PRESIDENT We concur the above findings. MEMBER MEMBER Rhr.,
