ORAL ORDER

Per Hon’ble Mr.Justice S.B.Mhase, President

          Consent terms have been submitted by the appellant and respondent.  On behalf of appellant consent terms have been signed by the advocate under special power of attorney to compromise the matter.  Respondent and respondent’s advocate have signed the consent terms. As per the consent terms, an amount of `30,123.50ps. charged by way of roaming charges is waived by the appellant in favour of respondent.  Amount of costs and the mental agony, etc. which was directed by the District Forum amounting to `5,000/- have been deposited in the State Commission and the same is decided to be given to the respondent. It is also agreed between the parties that the respondent is not going to claim the security deposit which is with the appellant.  Thus, the appellant and respondents have severed their relationship of ‘consumer’ and ‘service provider’.  In view of this appellant has stated that appeal is being withdrawn.  Appeal stands disposed of in terms of consent terms. Consent terms are marked as Exhibit X for identification.  Pronounced in the open court.

Copies of the order be furnished to the parties.
