Complainant files hazira through Advocate.

No step is taken by the O.P. who is found absent on repeated call. No Written Version is filed within the statutory period.

The case is fixed for Ex-Parte hearing.

The Complainant’s case is that he purchased three gem stones namely Rokto Prabal, Gomed and Amethyst for a total sum of Rs.18,617/- from O.P. under Cash Memo dated: 10/12/2022. After using it for 15 days colour of Gomed and Amethyst started fading. Being suspicious about the genuineness of the gemstones the Complainant approached the O.P. for return of Rs.8,242/- as the price of Gomed and Amethyst but of no avail. Hence this case.

On perusal of the entire complaint case and the documents filed therewith the Commission finds that the testing report dated: 02/12/2022 and 19/10/2022 shows that Gomed and Amethyst gemstones are both found natural and subsequent testing report dated: 20/09/2023 identifies the Amethyst gemstone as imitation but Gomed gemstone as natural. Thus the Amethyst gemstone is found not to be genuine as per testing report but the Complainant has prayed for refund of price of both Gomed and Amethyst gemstone.

In view of contradictory testing report the Commission cannot come to any conclusion about the genuineness of the gemstone in question.

The case therefore fails.

Hence it is ordered…….

That the case be and the same is dismissed Ex-Parte but without cost.

Both parties be supplied copy of this Order free of cost.
