We are not impressed with the submission made by Shri. Raikar. C.C. No. 31/13 was filed by Shri. Anil D'Souza as Manager of the same establishment and on the basis of the same cause of action. The complainant Shri. Anil D'Souza was given leave to withdraw the complaint with liberty to file a fresh complaint and that too within a period of 30 days. This C.C. No. 66/13 which is filed by the same establishment and on the same cause of action was admittedly not filed within 30 days from 13/5/13. Being so, it was the duty of the complainant to have explained to the Lr. District Forum as to why this complaint was filed in another name or for that matter why it was not filed within 30 days from 13/05/13. The complainant wanted to play hide and seek with the Lr. District Forum by suppressing the said order dated 13/05/13 and therefore the Lr. District Forum could not be faulted in imposing costs of Rs. 5000/- on the complaint. The said costs shall now be paid by the complainant into the Consumer Welfare Fund(and not to the District Forum) within a period of 30 days.

Except for the above modification, we find there is no merit in this appeal and consequently the same is hereby dismissed.
