            Heard learned counsel for the petitioner.

2.         Learned counsel for the petitioner submitted that after receiving notice they have already filed objection and written version.But the learned District Commission without hearing on maintainability of the complaint has insisted for release of the vehicle. Therefore, he wants for intervention of this  Commission.

3.         Considered the submission. Perused the DFR and impugned order.

4.         After going through the impugned order, we are not inclined to interfere with the same. Therefore, we hereby direct the learned District Commission to hear the complaint case on maintainability at first then to hear on merit if the entire pleadings are completed, within 30 days from the date of receipt of this order.

5.         Learned counsel for the appellant is directed to produce the copy of this order before the learned District Commission on 30.12.2022 . Till disposal of the petition on  maintainability, the impugned order will not be given effect to.

6.         Revision petition is disposed of accordingly.
