ORDER

          The case is called out.

          The instant appeal is pending since last more than 2 years and almost on each and every date fixed, counsel for the appellant was absent. Today again he is absent.

          On behalf of the respondent/complainant Sri Piyush Mani Tripathi and Sri Rishabh Raj, ld. counsels are present.

Heard ld. counsel for the respondent/complainant.

I have gone through the judgment and order of the ld. District Consumer Commission dated 2.5.2022 passed in complaint case no.6 of 2020 which is as follows:

“परिवादी का परिवाद आंशिक निर्णित किया जाता है। विपक्षी को निर्देश दिया जाता है कि आज के दिनोंक से 30 दिन के अन्दर वाद दाखिल करने की तिथि से पैनाल्टी में जमा की गयी रकम अंकन 10,21,210/-रू० मय 6 प्रतिशत साधारण वार्षिक ब्याज सहित देय तिथि तक परिवादी को प्रदान करे साथ ही आर्थिक व शारीरिक मानसिक क्षति के रूप में 5000/- रू० वाद व्यय के रूप में 3000/-रू० भी विपक्षी परिवादी को अदा करेगा। असफल रहने पर परिवादी उपरोक्त सभी रकम जरिया न्यायिक प्रक्रिया प्राप्त करने का अधिकारी होगा।”

After going through the entire judgment and order of the ld. District Consumer Commission and after hearing the counsel for the respondent/complainant, I do not find any irregularity or illegality in the impugned judgment and order.

Therefore, the appeal is dismissed, both on the ground of non-appearance as well on merits.

If any amount is deposited by the appellant at the time of filing of this appeal, may be remitted to the District Forum concerned for satisfying the decree as per rules alongwith accrued interest upto date.

The impugned judgment and order passed by the ld. District Consumer Commission is affirmed.

          A certified copy of the order will be placed by the appellant/complaint within two weeks from today.  

          The Stenographer is requested to upload this order on the website of this Commission at the earliest.
