Complainant files hazira. Complainant files a petition praying for withdrawal of the case on the ground stated therein supported with an affidavit. Today is fixed for filing W/V as last chance by ops. On repeated calls none appears for the ops and all ops are found absent. In the result, under compelling circumstances the petition of the complainant for withdrawal of the case is taken up for hearing. Heard the ld. Advocate of the complainant and complainant himself in person. Complainant openly before us candidly submits that he does not want to proceed further with the case as the matter has been settled between the parties outside the Forum.

In this background this Forum does not stand as hindrance relating to the disposal of this case as sought for by the complainant. However, some stringent and strict order should be passed so that over this cause of action and over the subject matter of this case if complainant files any case in future of that case complainant will be saddled with exemplary cost and has to suffer consequences and at the same time, the complainant is not giving any sort of liberty to file any fresh case in the same subject matter of this case in future.

In view of the above discussion the prayer of the complainant is allowed and complainant is permitted to withdraw the case according to the observation made hereinabove and thus, this case is disposed.
