ORDER

The record is put up at the instant of the Jdrs, who files a petition for recalling W/A against them. The petition be treated as M.A No. 33/2018.

            Heard both sides. Strong objection is raised by the Ld. Advocate/Agent of the Dhr.

            Ld. Advocate/Agent of the Jdr. Nil Madhab Mondal and others shows Xerox of the certified copy of the order passed in FA No. A/154/2018, arising out of the original C.C. case No. 81/14 of this Forum, by the Hon’ble State Commission.

            We find that Hon’ble State Commission has been pleased to fix 07.05.2018 for S/R and appearance and Appeal was accompanied with a petition for condonation of delay. We also find that Hon’ble State Commission also has not been pleased to pass stay order.

            We further find that self-same prayer of recalling W/A against the Jdr was rejected on 19.02.2018 by this Forum.

            So, we find nothing and the petition is liable to be rejected.

            Hence,

Ordered

that the petition dated 09.04.2018 filed by the Jdr for recalling W/A issued against them i.e. M.A No. 33/2018 be and the same is rejected without cost.

Thus the M.A. is disposed of accordingly.
