ORDER

Complainant called out, not present. Opposite party also called out, he is not present. This complaint was filed for refund of Rs.1,500/- with cost and interest on the ground of deficiency in service. Notice was duly served on the opposite party who appeared and filed application for setting aside exparte order. The same was allowed. The matter is pending since long for affidavit and documents by both parties. It is seen from the order sheet that matter is pending for affidavit and documents since 9-1-2001. Both parties remained absent. There are no grounds to grant further time. Hence we proceed to pass the following order. Complaint is dismissed for non-prosecution. No costs.
