Appellant through Mr. Deb Narayan Roy, the Ld. Advocate and Respondent through Mr. Ashoke Nath Mukherjee, the Ld. Advocate along with Mrs. Nabanita Kar, the Ld. Advocate are present.

The Appellant files an application by stating that the Appellant does not want to press the appeal as the Appellant instead of pressing the appeal want to execute the order as passed by the Forum below.  In view of the prayer so made by the Appellant this appeal is dismissed for non-prosecution.  Since the Appellant is not pressing the appeal and wants to put the impugned order in execution so he is permitted to take back the certified copy which has been annexed to the memorandum of appeal upon filing a Xerox copy of the same.  Office is accordingly directed to return the certified copy of the impugned order to the Ld. Advocate for the Appellant forthwith.
