The Ld. Advocate for the respondent no. 1 is present. None appears on behalf of the revisionist.
It appears in terms of order no. 14 dt. 20.10.2022 no cost was paid by the revisionist amounting to Rs. 1000/- payable to the respondent no. 1. As this is a matter of revision, the case could not be dismissed for non compliance of the order of this Commission without entering into the merit of the revision application.
Heard the Ld. Advocate for respondent no. 1.
The revisionist questions the legality of the order dt. 27.05.2022 passed by the Ld. DCDRF, Rajarhat in CC/54/2021.
It appears from order dt. 23.05.2022 being the impugned order passed by DCDRC, Rajarhat that on the said date as the OP Sudha Memorial School did not file any W.V.
The Ld. Forum below observed that the period for filing W.V was over. So, the case do proceed ex parte against him.
It appears that within the statutory period of 45 days the OP no. 1 of the case did not file any W.V. So, the Ld. Commission passed the impugned order to the effect that the case would proceed ex parte against them.
The complainant of this case Pradip Kr. Nandi is the present respondent no. 1.
Considering the position of law, I am of the view that the impugned order does not suffer from any illegality and no interference is required.
Accordingly, the revision petition being no. RP/102/2022 is dismissed. Impugned order is upheld. There shall be no order as to the costs. The Ld. Forum below is requested to dispose of the case in accordance with law.
Order of stay in connection with the present revision stands vacated.
Let a copy of this order be sent to the Ld. DCDRF, Rajarhat.
