Today  is fixed for awaiting order from the Hon’ble State Commission.  The OP of this C.C. Case is found ready and has filed copy of order passed in R.P. Case No. 144/2022 by the Hon’ble State Commission on 11.09.2023.  The copy of the said order has also been received by this District Commission during official course of business and it is lying with the case record.

Most respectfully, seen the order of the Hon’ble State Commission wherefrom it appears  that Hon’ble State Commission has been pleased to set aside the order passed by this District Commission in MA Case No. 09/2022 vide Order No. 4 dt.30.08.2022. Hon’ble State Commission has also been pleased  to observe that the  complainant is not a consumer and so Hon’ble State Commission has been pleased to direct  this District Commission to pass necessary order of this CC Case .

In view of the observation of Hon’ble State Commission observed in the order dt. 11.09.2023 passed in R.P. Case No. 144/2022 .  This District Commission finds that the CC Case is not maintainable.

As the CC Case is not maintainable,  it is required to be dismissed.

In the result, it is accordingly,

ORDERED

That  this CC Case No. 06/2022 be and the same is dismissed as it is found not maintainable.  No order is passed as to cost.

Let the order of the Hon’ble State Commission be tagged with this case record.
