:    J U D G M E N T    :

This is a case against Prabir Tapader, the owner of Charmahatpur Brick Field, Dhubulia, Nadia filed by Chandana Paul.  The facts of this case are as under:-

Chandana Paul paid Rs. 1,79,000/- for purchasing bricks from the OP for 39800 bricks.  The money was received by the OP as per the receipt filed before this Forum, but the bricks were not supplied. 

Hence, the complainant had to knock at the door of the Forum on 16.09.2014 by filing a complaint. 

The complainant has filed himself an affidavit in support of his claim.

The unchallenged testimony of the complainant has proved the case of the complainant that he paid Rs. 1,79,000/- to the OP, Prabir Tapader but he neither paid back the money nor supplied the bricks.  Hence, the complainant is entitled to get a decree of Rs. 1,79,000/- and he is also entitled to get interest @ Rs. 5% per month upon the amount from the date of filing the case till the date of realization.    The complainant is also entitled to get Rs. 500/- by way of compensation for his harassment.

That the case, CC/2014/143 be and the same is decreed ex parte.  The OP, Prabir Tapader is directed to pay Rs. 1,79,000/- plus interest @ Rs. 5% per month upon the amount from the date of filing the case till the date of realization along with Rs. 500/- as compensation to the complainant within 12.05.2015.

            Let a copy of the order be supplied to the parties free of cost.
