SRI.P.V.JAYARAJAN: PRESIDENT

This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:

This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party.  After admitting the complaint notice was issued to the opposite party.  The opposite party entered appearance and filed written version denying the allegation raised by the complainant.  When the case came up for consideration on 21/03/2023, both parties were present and submitted that there is a chance of settlement and hence the matter was referred for mediation to be held on today. After discussions both parties submitted that the matter settled for Rs.45,000/-.  As per the terms of compromise, the opposite party agreed to pay the said amount by way of DD drawable in the name of the complainant within 3 months from the date of settlement and the complainant has agreed to issue a receipt for the same on receipt of the said DD.  A compromise memo signed by both parties is also produced before this Commission.  The compromise memo dated 01/04/2023 is accepted and recorded.  In view of the settlement arrived at between the parties to the proceedings, we find that this is a fit case to be allowed in terms of compromise. 

In the result the complaint is allowed in terms of compromise.  The compromise memo dated 01/04/2023 will form part of this order. 

A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
