ORDER
SRI.P.V.JAYARAJAN: PRESIDENT
This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party. After admitting the complaint notice was issued to the opposite party. The opposite party entered appearance and filed written version denying the allegation raised by the complainant. When the case came up for consideration on 28/03/2023 both parties submitted that there is a chance of settlement and hence the matter was referred to mediation. When the case came up for consideration today, the compromise memo signed by both parties and their respective counsel is filed before this Commission. As per the compromise memo, the matter is settled for a total amount of Rs.1,15,000/-. As per the compromise memo dated 20/05/2023 out of the total amount of Rs.1,15,000/- the opposite party has agreed to pay Rs.85,000/- through RTGS to the complainant as goodwill amount and voucher for 200 ltrs. diesel or equivalent cash to the complainant within 15 days from the date of settlement. Apart from that the opposite party is also agreed to pay late fee for the registration purpose as actual amount and a seat cover shall also be provided to the vehicle for the remaining amount. The compromise memo dated 20/05/2023 is accepted and recorded. In view of the settlement, we find that this complaint is to be allowed in terms of compromise.
In the result the complaint is allowed in terms of compromise. The compromise memo dated 20/05/2023 will form part of this order.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
