            Heard. Perused the records.

The complainant is a company registered under the Companies Act 1956, engaged in gold loan business through various branches of all over India. The complainant purchased 21 generators from the opposite party for the use of the same at its branches in various places. So the complainant has purchased generators for commercial purposes. So the complainant is not a consumer as defined under section 2(1) (d) of the Consumer Protection Act. The subject matter of the complaint is not a matter coming within the purview of the Consumer Protection Act. Hence the complaint is not maintainable before this Commission and the complaint is dismissed.  The complainant has to agitate the matter before the appropriate Forum / Civil Court.
