ORDER

SRI.P.V. JAYARAJAN, PRESIDENT:

This is a complaint filed under section 12 of Consumer Protection Act 1986 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:

This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties.The 2nd opposite party entered appearance and filed written version denying the allegation raised by the complainant.1st & 3rd opposite parties not appeared after accepting the notice and hence set ex parte.When the case came up for consideration on 23/11/2022 the counsel for the complainant submitted that the complainant is no more and sought time for ascertain whether the legal heirs of original complainant are interested to further proceed with this complaint.Hence this case was adjourned to this date for appearance of legal heirs of original complainant.When the case came up for consideration today, counsel appearing for the complainant submitted that the legal heirs of the deceased complainant are not interested to further proceed with this complaint.In the above circumstances we find that this is a fit case to be dismissed as abated.

   In the result complaint is dismissed as abated.  There will be no order as to cost.      

A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
