SRI.P.V.JAYARAJAN: PRESIDENT
This is a complaint filed under section 12 of Consumer Protection Act 1986 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party. After admitting the complaint, notice was issued to the opposite party. The opposite party accepted notice issued from this Commission and entered appearance before this Commission and filed version denying the allegation of deficiency in service raised by the complainant. Since 12/11/2019 this case was posted for filing affidavit of the complainant. Though the complainant filed an affidavit, he failed to appear before this Commission to adduce evidence or to mark the document produced by him. As such there is no evidence before this Commission to substantiate the case of the complainant. As the complainant was continuously absent, on 02/11/2020 this Commission issued notice to the counsel appearing for the complainant to appear before this Commission they said notice was served on the counsel for the complainant. But Subcequent to that also, there was no representation for the complainant. In the above circumstances we find that the complainant is not willing to further proceed with this complaint.
In the result the complaint is dismissed as settled. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
