No step is taken by the Complainant. Ld. Advocate for the OP is present. He submits before this District Commission that the claim of the Complainant Smt. Nirupa Das has been settled and an amount of Rs. 26,515/- has been sanctioned for payment through cheque No. 936588 dated 17.09.22 and the same has been handed over to the claimant i.e. Smt. Nirupa Das and the said cheque was received by the claimant on 20.09.22 as per article tracking report from indiapost website. Superintendent of Post Office, Murshidabad Division has submitted a letter before this District Commission to that effect. In the instant case, the Complainant Smt. Nirupa Das filed the instant case on 25.03.22 alleging deficiency of service on the part of the OPs. The materials on record shows that the claim of the Complainant has been settled and the Complainant received the cheque on 20.09.22. The record further shows that the Complainant had not taken any step on 13.01.23 and 27.04.23. Today also i.e. 02.05.23 no step is taken by the Complainant. The conduct of the Complainant shows that she is not interested in the instant case. The OP is a Government Official. Considering the facts and circumstances of the case we are of the view that the contents of the letter of the OP is required to be accepted and ultimately the instant case is liable to be dismissed on merit. In the result, the instant case fails. Fees paid are correct. Hence, it is Ordered that the instant case bearing No. CC/20/2022 be and the same is dismissed on merit without cost against the OPs. Let plain copy of this order be supplied free of cost, to each of the parties / Ld. Advocate/Agent on record, by hand /by post under proper acknowledgment as per rules, for information and necessary action.
