Final Order / Judgement

Order No. 31 dtd.17.05.19

                                The case is posted today for hearing and order. Non appears on behalf of the complainant. Ld. Counsel Md. Nayeem being present filed hazira on behalf of the Ops, perused the documents filed by the parties. In the complaint, it is alleged that complainant has deposited Rs.10,600/- at Karilopatna Sub-Post Office vide pass book No.19663. Though the complainant deposited the pass book before the concerned postmaster for availing the maturity amount on dtd.13.03.15 and obtained receipt in support of deposit of the pass book, but till-date she has not received the legitimate amount. Ops on their defence admitted the deposit of said R.D. account, which was matured on dtd.22.05.2012 and such non-payment of matured amount came to the knowledge of Ops after filing of the present C.C.Case. It is version of the Ops that, on dtd.30.03.2019 complainant has received the matured amount of Rs.10,600/- alongwith Rs.5797/- as total interest and the account has been closed. The receipt voucher is filed into the case as Annexure-R/1.

           Considering the entire allegation and its counter, we are of the opinion that complainant has received the amount on dtd.30.03.19 as per Annenxure-R/1. The case record reveals that, complainant is remaining absence since long, and it appears that complainant has no more claim as per the complaint on receipt of the matured amount on dtd.30.03.19 without any protest. Accordingly, the complaint is disposed of without any cost and Ops are freed from allegation of deficiency in service as alleged by the complainant.

                        Pronounced in the open Court, this the 17th day of May,2019.
