  1. This order shall dispose of an application filed by Complainant for restoration of the complaint which was dismissed vide order dated 11.07.22 for non-prosecution.  We have heard the counsel for the Applicant/Complainant. We have also perused the file.
  2. The case of the Applicant is that due to corona pandemic he could not appear before this Commission. It is submitted that the order dated 11.07.22 be reviewed as the non-appearance was beyond the control of the Applicant. The perusal of the file shows that Complainant did not appear before this Commission after 04.02.20. The case was ultimately dismissed on 11.07.22. The Applicant did not appear before this Commission for more than 2 years 5 months. During this period, the case was adjourned several times but the Complainant did not ever appear before this Commission. The perusal of the file further shows that during this period normalcy has returned and everything was going smoothly. Even then the Complainant did not appear before this Commission for such a long period and the Opposite Party appeared on many dates. The order u/s 40 of the Consumer Protection Act can be reviewed only if there is any error apparent on the face of record. In the present case, there is no such error which is apparent on the face of record.  Therefore, we do not see any merit in the application. The application is dismissed accordingly.
