Rajesh Khanna Versus Post Master

 

Present:- Sh.Robin Budhiraja, Advocate Counsel for the Complainant.

 

Sh.Vinod Kumar (PRI), Authorised Representative of the Opposite Party along with Counsel.

 

File taken up today as on 06.02.2018 the President and the Member were on Leave. The case is fixed for final arguments, but Sh.Vinod Kumar, Authorised Representative of the Opposite Party submitted a photostat copy of two Cheques bearing No. 161890 dated 05.02.2018 for amounting to Rs.57,610/- and Cheque bearing No. 161889 dated 05.02.2018 for amounting to Rs.40,489/- and further submitted that the maturity amount of the FDRs along with interest till today has been paid to the complainant and same has been accepted by the complainant and to this effect statement of the Authorised Representative of the Opposite Party has been recorded separately.

Counsel for the Complainant as well as complainant admitted that he has received the aforesaid Cheques, but further claim i.e. entitle for compensation for the delay payment. As per version of the Authorised Representative of the Opposite party Sh.Vinod Kumar, the Complainant has submitted documents in regard to his claim as a nominee, Passbook of TD Accounts, Claim Application, Address Proof of the Complainant and after receipt of the aforesaid documents, the claim of the complainant has been immediately settled on 05.02.2018, but the factum as regard to submit of all required documents have not controverted by the complainant in any manner, so it means the complainant himself at fault for not completing all

the formalities for getting the maturity amount of the FDRs. Rather the same has been completed by the complainant on 05.02.2018 and therefore, we do not find any deficiency in service on the part of the Opposite Party and the complainant is not entitled for any compensation or litigation expenses, whereas the maturity amount of both the FDRs has already been received by the complainant. Therefore, this complaint is dismissed as fully satisfied. Copies of the order be supplied to the parties free of cost, as per Rules. File be consigned to the record room.
