Final Order / Judgement

        Case called out repeatedly. Complainant is absent. O.Ps are present through Counsel. It appears from perusal of the record that, the complainant is not appearing since 30/11/2015 and has not filed his rejoinder affidavit after filing of the counter affidavit by the O.Ps. The complainant has filed the present complaint for issuance of duplicate passbook for N.S.S Account No.14844 maintained by O.P. No.2 and 4 and also for the payment of the maturity amount of the said account, on the ground that his passbook was lost somewhere in Sadar area Agraon 14/01/2012 regarding which he has lodged F.I.R. in P.S. Sadar Bazaar, Agra. The O.Ps have filed their written statement and submitted that the complainant has not furnished any copy of the F.I.R. to the O.P. till date and duplicate passbook could not be issued to the complainant because, the interest statement since 2008-2009 to 2012-2013 did not include the account number of the complainant meaning thereby, the account was closed by the complainant before the year 2008-2009. Since, the account did not exist in the records of the O.Ps hence, there was no occasion to issue the duplicate passbook. According to the O.P, the complainant has already withdrawn the amount of the said N.S.S. Account on the basis of original passbook and has filed the present complaint on the the basis of the photocopy of the passbook. Mr. Satish Solanki, Senior Superintendent of Post Office, Agra Division has filed his counter affidavit on behalf of the O.Ps. Since then, the complainant took time but, he did not file his rejoinder affidavit against the counter affidavit filed on behalf f the O.Ps. The complainant has not filed copy of F.I.R. before this Forum also therefore, in view of the facts mentioned in the written statement of the O.Ps and there counter affidavit. This Forum is of the definite opinion that, there was no deficiency in the services of the O.Ps therefore, the present complaint is liable to be dismissed. The present complaint is dismissed accordingly. Let record be consigned.
