Shri Sundarlal Behera, President:- In brief, facts of the case is that, the complainant bought NSC of Rs.40,000/- only from the O.P.No.2 vide Account No. 3460452334 through cheque vide cheque No.10655 dtd.08.12.2016 of Oriental Bank of Commerce, Jharsuguda which was collected by the O.P.No.2 on dtd. 13.12.2016. The O.P.No.2 issued NSC on dtd. 26.12.2016 after lapse of 13 days. The complainant send a request letter on dtd. 03.02.2017 for correction of issue date but the O.P.No.2 has not taken any action, hence this case.
Being noticed through this Forum, the O.Ps. are neither appeared before this Forum nor submit their written statement, hence the O.Ps. are set ex-parte. Heard from the complainant, perused the case record and available documents. The complainant has purchased NSC of Rs.40,000/- only through cheque which was collected by the O.P.N.2. on dtd. 13.12.2016 from saving bank account bearing account No. 11482191002531 of Oriental Bank of Commerce, Jharsuguda but the O.P. No.2 issued NSC on dtd. 26.12.2016 i.e. after 13 days after receipt of amount. The complainant intimated in writing which was duly received by the O.p.No.1 but till date did not take any action. The O.Ps. remained silent which reveals that the O.Ps have nothing to say in this case.
Hence the complaint petition is hereby allowed with directions to the O.P.No.2 to make necessary correction in the date of issuance i.e from the date of receiving for NSC amount from the complainant and issue afresh NSC. The O.P.No.2 is hereby further directed to pay a sum of Rs.1000/- (Rupees one thousand) only towards harassment, mental agony including litigation costs to the complainant within 30 (thirty) days from the date of receipt of this order.
Accordingly the case is disposed of.
Order pronounced in the open court today on this the 26th day of July 2017, copy of this order shall be communicated to the parties as per Rule.
