ORDER

JUDGEMENT & ORDER

Mr. Ratul Paboh, complainant present and heard. Post Master, Pasighat respondent No. 1 not present. Mr. Rio Pao Branch Post Master, Oyan respondent No. 2 present.

Mr. Rio Pao, Sub-Post Master, Oyan expressed his inadequate knowledge of the complaint in the case.

Ratul Paboh, complainant submitted that he was an aspirant candidate for APPCSE Exam, the prelim of which was scheduled on 10.01.2010 but the call letter for prelim exam reached him at Oyan on 25.3.2010. The letter was dispatch from Itanagar Post Office on 12.12.2009 and reached Pasighat Post Office on 18.12.2009 and he received on 25.3.2010 at Oyan. As such, he could not appear the exam.

This District Forum heard both the parties in last hearing on 3.7.2010 and directed Post Master, Pasighat and Branch Post Master, Oyan to produce relevant records or documents of the said letter between 18.12.2010 to 25.3.2010 on next hearing but they failed to produce to defend their case.

Since the case has been delayed considerably, the Forum is of the opinion that though sufficient time was given for producing relevant records where about of the said call letter, the Department of Post & Telegraph in Pasighat and Oyan failed to produce the records as directed. Thereby, the Department is not showing seriousness in discharging their duties which amounts to negligence and dereliction of duties.

By not delivering the call letter to complainant Shri Ratul Paboh in time to enable him appears the exam, the act of which rendered loss of an opportunity in carrier making. Thus the Department of post and Telegraph is found to be negligence and dereliction of duties.

The Department of Post and telegraph is therefore, held responsible for delay in delivering the call letter to complainant and this court direct the post and Telegraph Department to pay a compensation amounting to Rs. 20,000/- (Rupees twenty thousand)  only to compensate the complainant of his mental agony and loss of carrier opportunity. The amount be paid within 90 days from date of issue of this order.

Copies of this order be given to Post Master, Pasighat, Sub-Post Master, Oyan and the complainant.
